What’s Next for China Safeguard Measures: Seminar Friday, September 18, 2009 With President Obama due to issue his first decision on a request for a safeguard measure against Chinese imports by September 17, the big question is what his decision will mean for the future of this special exception to normal trading rules. Section 421 — the China product specific safeguard — allows the United States to impose duties or establish a quota for up to three years on Chinese products that are found to have caused “market disruption” as a result of increased trade. President Bush declined to approve any of the 421 petitions presented during his Administration, finding that the harm to the economy as a whole outweighed any benefit that the petitioning industry might have received from temporary duties or quotas. Speculation is high that President Obama will provide some relief to U.S. consumer tire workers. If so, will that cause a flood of new petitions? How likely is it that petitions will be filed against apparel made in China? How does the Section 421 process work and what are the steps companies can take to best prepare for such a proceeding?

New Rules for Haiti and Cumulation with Mexico for DR-CAFTA July 31, 2008 The Rules keep changing, for Haiti and for DR-CAFTA. It's time to update your knowledge. Congress recently made big changes in the rules for duty-free apparel made in Haiti, giving manufacturers and importers more options and new hope for doing business there. A program to promote worker rights is also part of the new law.
At long last, on August 15, the cumulation provisions of DR-CAFTA will allow Mexico and the DR-CAFTA countries to collaborate to produce duty-free garments. Find out how to take advantage of this new flexibility.
Costa Rica should join DR-CAFTA soon, triggering a firm 90-day deadline for claims for retroactive benefits for products that would have qualified for DR-CAFTA had it been in force since January 1, 2004.
